The My Pool Expert application and associated website (collectively, the "Service") are operated by BAYROL Deutschland GmbH, Robert-Koch-Straße 4, 82152 Planegg, Germany, together with BAYROL France SAS and BAYROL Iberica SLU ("BAYROL", "we" or "us").

2. ACCEPTANCE OF TERMS

By accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms of Use. If you do not agree, you must not use the Service.

We may update these Terms of Use from time to time. We will notify you of significant changes via the application or website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

3. PERMITTED USE

The Service is provided for your personal, non-commercial use only to assist you in the maintenance and care of your pool and/or spa (including hot tubs).

When using the Service, you agree not to:

  • attempt to undermine the security or integrity of the Service or BAYROL's computing systems or networks;
  • use or misuse the Service in any way that impairs its functionality or the ability of other users to access it;
  • attempt to gain unauthorised access to any part of the Service or to the systems on which it is hosted;
  • transmit any files or content that may damage any person's computing devices, that are offensive, or that violate any law;
  • attempt to modify, copy, adapt, reproduce, disassemble, decompile or reverse engineer any software used to deliver the Service, except as strictly necessary for normal operation or as permitted by law;
  • impersonate any other person while using the Service;
  • conduct yourself in a vulgar, offensive, harassing or objectionable manner; or
  • use the Service for any unlawful purpose.

5. DISCLAIMERS

The Service and its content, including water analysis results, dosage recommendations and AI-assisted guidance, are provided for informational purposes only. You should not rely solely on the Service when making decisions about pool or spa water treatment. Always verify recommendations against the relevant product label and instructions for use and, where appropriate, seek advice from a qualified professional.

BAYROL does its best to ensure that the information provided through the Service is accurate and up to date but cannot guarantee that this will always be the case.

BAYROL aims to make the Service available at all times but it may occasionally be unavailable due to maintenance or factors outside BAYROL's control.

The Service may contain links to third-party websites or services not controlled by BAYROL. BAYROL is not responsible for the content, terms or privacy practices of such third parties.

6. INTELLECTUAL PROPERTY

BAYROL is the owner of the Service, including all software, applications, domains, content, graphics, logos, icons and service names made available through it. All intellectual property rights in the Service belong to, or are licensed to, BAYROL. You do not acquire any rights to such intellectual property by using the Service, except as expressly set out in these Terms of Use.

You agree that BAYROL is free to use any feedback, comments or ideas you submit through the Service for any purpose, including improving the Service and developing new products, without compensation or acknowledgement.

7. LIMITATION OF LIABILITY

BAYROL is only liable to you for losses that you suffer as a direct result of BAYROL's breach of these Terms of Use and that are reasonably foreseeable. BAYROL is not liable for indirect losses, business losses (including loss of profits, contracts, goodwill or opportunity), or damages caused by a breach of a non-material contractual obligation.

Nothing in these Terms of Use excludes or limits BAYROL's liability where it would be unlawful to do so.

8. GOVERNING LAW

These Terms of Use are governed by German law. Any dispute or claim arising out of or in connection with these Terms of Use shall be subject to the non-exclusive jurisdiction of the courts of Germany.
